Ivo Rosa says he is waiting for a response from the PGR regarding access to inquiries

Ivo Rosa provided a written response stating that he is aware of three inquiries, which “appear to be all archived,” according to information obtained “following a request made to the Public Prosecutor’s Office with the Supreme Court of Justice.”

“I am still waiting for information from the PGR about the total (and which) inquiries have been opened by the Public Prosecutor’s Office concerning me,” added the judge, who also requested access to them and is still awaiting a “response from the Attorney General’s Office with the Supreme Court of Justice to this request.”

Following last week’s report by CNN/TVI about an inquiry opened into Ivo Rosa after an anonymous complaint was received by the Central Department of Investigation and Prosecution (DCIAP), the now appellate judge stated that he has never been “informed, contacted, or notified in the context of any inquiry” and therefore is unaware “except for the information disseminated in the media, of the content of the same, the procedural actions carried out in each of them, and the reasons, in fact or law, for the archiving.”

Given the “lack of concrete elements, namely the reasons for the opening of several criminal inquiries targeting a criminal investigating judge and the content of actions taken,” Judge Ivo Rosa considered it “not possible to provide any further clarification.”

CNN/TVI reported last week that Ivo Rosa was the subject of a criminal process while serving as a judge at the Criminal Investigation Court, allegedly based on an anonymous complaint received by DCIAP and the Judiciary Police (PJ).

In this investigation, the Public Prosecutor’s Office reportedly accessed the former judge’s billing, mobile phone location, and bank accounts, CNN/TVI added, due to suspicions of corruption, embezzlement, and money laundering.

The criminal process was opened at the beginning of 2021, months before Judge Ivo Rosa, in April of that year, announced the instructional decision of the Operation Marquês process, in which he dropped most of the crimes charged by the Public Prosecutor’s Office. This decision was later overturned by the Lisbon Court of Appeals.

This week, the PGR assured, in a statement, that the measures taken during the investigation into Judge Ivo Rosa, between 2021 and 2024, respected the rights, freedoms, and guarantees provided by law and did not include telephone interceptions.

“In this investigation, the Public Prosecutor’s Office was assisted by the Judiciary Police. Once gathered, the evidence required analysis. Upon completion, the Public Prosecutor’s Office with the Supreme Court of Justice decided, on March 20, 2024, to archive the inquiry,” the PGR’s clarification noted.
