The Aveiro Court sentenced the defendant to two years and three months of effective imprisonment for committing a crime of domestic violence. The defendant appealed to the TRP, which, in a decision dated November 26, rejected the appeal.
The defendant and the victim married in 2002 and settled in Aveiro.
According to the decision, the last years of their relationship, between 2020 and 2024, were marked by several episodes of domestic violence against the woman, which, in one instance, led to her requiring hospital treatment.
The assaults involved punching, pushing against the wall, pulling hair, and strangling, occurring while the defendant was benefiting from a suspended sentence for a similar crime against the same victim.
In one described incident, the defendant broke several objects because he disliked the meal his partner had prepared. In another, he assaulted the victim because she refused to cook him a meal.
After several episodes of domestic violence, the victim was referred to a shelter for domestic violence victims in November 2020 but decided to return home after a week.
The court also found that these actions by the defendant caused the victim to fear for her physical health and even her life.
The defendant was already convicted in 2022 for domestic violence against his partner, sentenced to two years and 10 months in prison, with the execution suspended for the same period. He also has another conviction for a fine for an aggravated threat crime committed in 2018.
The appellate judges noted that the defendant shows “indifference and insensitivity” to previously imposed sentences, demonstrating the inefficacy of the suspended prison sentence.
Furthermore, they highlighted that the risk of recurrent behavior is high, noting that the defendant did not show any remorse or confession.
