
The European Commission announced through a statement that, following an investigation, it has concluded that Temu (a Chinese digital marketplace) violated the EU Digital Services Act.
The issue concerns the alleged sale of illegal products, notably “children’s toys and small electronic devices.”
“There is a high risk of consumers encountering illegal products on this platform,” stated the European Commission.
Ursula von der Leyen’s administration also determined that the assessment carried out in October 2024 regarding compliance with the legislation of the 27 member states of the EU “was inaccurate,” as Temu denied any likelihood of marketing products that were non-compliant with the law.
The European Commission will continue to investigate the matter, and the Chinese digital commerce platform has the opportunity to defend itself against the accusations.
However, if the Brussels executive concludes the law was indeed breached, it may proceed with a fine of up to 6% of the total annual revenue.
Temu may also be subject to surveillance processes until it complies with the necessary requirements to operate within the European Union.
