Constitutional Court announces decision on foreign law at 5 PM

The External Relations Office of the Constitutional Court (TC) announced that a press conference will be held in the Public Acts Room of the Ratton Palace, the headquarters of the TC in Lisbon, at 17:00.

The TC’s decision follows a request from the President of the Republic for a preventive review of this decree on July 24, asking the TC to respond “urgently,” within a maximum period of 15 days, which expires today.

The decree was passed on July 16 in the Assembly of the Republic, with the approval of PSD, Chega, and CDS-PP, while IL abstained and PS, Livre, PCP, BE, PAN, and JPP voted against it.

Almost all parties except PSD, Chega, and CDS-PP criticized the legislation, deeming it unconstitutional and condemning the legislative process for not consulting migrant associations or constitutional experts and for lacking mandatory opinions.

In his request sent to the TC, President Marcelo Rebelo de Sousa called for a preventive review of the constitutionality of the rules concerning the right to family reunification and the conditions for its exercise, the timeframe for the Agency for Integration, Migration, and Asylum (AIMA) to assess applications, and the right to appeal.
