ANAC: Hand luggage is free if it complies with the carrier’s rules.

The regulatory authority has issued a statement following reports and social media discussions concerning alleged improper charges for carry-on luggage by airlines.

The agency led by Ana Vieira da Mata emphasizes that airlines are free to establish their own carry-on baggage policies but must clearly communicate them at the time of ticket purchase.

Passengers are advised to inform themselves beforehand about the specific rules of each airline, as these can vary, including weight, dimensions, and applicable security regulations.

The regulator further notes that under European Union legislation, airlines have the liberty to set prices and charge for additional baggage items, including checked or extra carry-on luggage beyond the basic allowance.

ANAC highlights that a review of European rules on passenger rights is currently underway, which may offer greater clarity regarding carry-on luggage dimensions. However, the positions adopted by the Council of the European Union on June 5 and the European Parliament on June 24 do not constitute a final decision.

The inter-institutional legislative process is ongoing, and once concluded, ANAC assures that any new applicable rules will be communicated.
