Are fines and penalties different? Is it possible to pay a fine in installments?

The terms ‘fines’ and ‘penalties’ are often used interchangeably, but do they hold the same meaning, or do differences exist? DECO PROTeste, a consumer protection organization, clarifies that a “fine is more severe due to its criminal nature, while a penalty results from an administrative infraction.”

The administering authorities also differ. In both instances, regulatory oversight may be conducted by authorities such as the PSP. However, the courts determine the punishment in the case of fines, whereas an administrative entity like the National Road Safety Authority or the Tax Authority can impose penalties, according to the organization.

Despite these differences, both result in monetary sanctions requiring financial payment.

Can I Pay a Penalty in Installments?

It is possible to request the installment payment of a penalty at any stage, up until the process advances to the execution phase,” explains DECO PROTeste. The appropriate form must be completed to apply for installment payments. The request can be sent or presented through one of the means already mentioned.

However, some conditions must be met to pay a penalty in installments:

  • The initial penalty set for the infraction must be equal to or greater than 204 euros;
  • The value of each installment must be at least 50 euros;
  • The payment period cannot exceed 12 months.

If an installment is not paid, the installment plan is canceled, and the full outstanding amount becomes due for payment, the organization concludes.
