CGD condemned for “violating parental rights” (and will have to pay)

The Labor Court has reportedly ruled against Caixa Geral de Depósitos (CGD) for violating parental rights, as revealed on Wednesday by the Sindicato dos Trabalhadores das Empresas do Grupo CGD (STEC). The bank is mandated to pay a compulsory fine of 100 euros per day for each day the employee was not permitted to work remotely.

“The Labor Court ruled in favor of a STEC member, authorizing remote work under Precautionary Measures backed by the union against CGD, pursuant to Article 166-A, No. 3 of the Labor Code,” stated a communiqué accessed by Notícias ao Minuto.

This regulation grants parents of children under eight the right to telework when job functions are compatible, which was applicable in this instance, according to the union.

CGD is now required to pay a compulsory fine of 100 euros daily for each day the employee was denied telework.

“The court also imposed a daily fine of 100 euros for any delay in complying with this decision, to be paid by CGD to the employee,” stated the media note.

STEC expressed regret over the situation, particularly highlighting its concern that a public company is involved, noting with “astonishment and perplexity” that CGD fails to practice the parental rights it professes.

“It is regrettable that a Public Company like CGD, expected to exemplify the strict adherence to parental rights, engages in practices violating these norms, thereby harming and penalizing its workers,” the statement emphasized.

STEC ultimately hopes CGD will comply with the court’s decision:

“The STEC leadership expects the CGD Administration to respect and fully comply with this Court’s decision, maintaining ongoing support for its members affected by practices violating their parental rights,” the statement continued.

The Sindicato dos Trabalhadores das Empresas do Grupo CGD, the major union for CGD workers, had previously filed another legal action against the group. This lawsuit concerned corrections to the electronic time registration imposed by CGD.

The company refused changes that, according to the union, deleted “thousands of hours of unpaid overtime,” which led to a serious infraction being imposed by the Labor Conditions Authority (ACT).

O Sindicato dos Trabalhadores das Empresas do Grupo CGD (STEC) vai levar para o Ministério do Trabalho a negociação salarial com o banco público, face à ausência de acordo, afirmando a Caixa que apresentou propostas “acima do setor bancário”.
