The defendant is subject to a probation regime and must pay the state 1,750 euros for the suspension of the sentence.
Another defendant, who facilitated contact with the fake prosecutor, was sentenced as an accomplice to 1 year and 6 months of suspended imprisonment, with the obligation to pay the state 2,000 euros.
Both defendants were convicted of aggravated attempted active corruption.
The fake prosecutor, a judicial official in the Póvoa de Lanhoso Court, was also accused of qualified fraud but was not tried, as he fully compensated the damage and the affected party agreed to terminate the proceedings.
The process started when the nightclub entrepreneur had a home detention measure applied in a criminal case. He discussed the matter with another defendant, who offered to put him in touch with a friend who had another friend, allegedly a prosecutor, who could help change his detention measure.
In February 2020, the defendant posing as a prosecutor and another accomplice contacted the businessman, convincing him to give them 50,000 euros to alter the measure. The businessman paid this amount in two installments: 20,000 euros and 30,000 euros.
However, the detention measure was not altered.
