Court of Appeal maintains electronic bracelet for firefighter from Machico

The firefighter from Madeira, who assaulted his wife in front of their son last August, will continue to be monitored with an electronic bracelet. This follows the Lisbon Court of Appeal’s decision on Tuesday to uphold the Funchal Court’s ruling. The accused will remain under this preventive measure while awaiting the legal proceedings.

The decision came on Tuesday after the Lisbon Court of Appeal deemed the measure “appropriate and in line with the community’s expectations of preventing further criminal activity, ensuring the investigation’s integrity, and maintaining public order and tranquility,” as reported by Jornal de Notícias (JN).

The 35-year-old defendant is also prohibited from contacting his wife and 9-year-old son through any means.

The defendant was initially placed in preventive custody following his first judicial interrogation. Since October 15, the firefighter from the Machico municipal corporation has been under a house arrest measure with electronic surveillance, as part of the periodic review of preventive measures.

What Does the Public Prosecutor’s Accusation Say?

The Public Prosecutor (MP) has filed charges against the firefighter arrested in August in the municipality of Machico, Madeira, on suspicion of two counts of aggravated domestic violence against his wife and 9-year-old son, which allegedly occurred in October.

The accusation claims that, in the early hours of August 24, 2025, the defendant went to a residence in Água de Pena, in Machico, where the victims were living, and “violently assaulted his wife in the presence of their son, who repeatedly asked his father to stop and even placed himself between his parents to protect his mother.”

A statement on the Madeira Public Prosecutor’s website noted that “the defendant and the first victim were married since 2010 but had not been living together since early August 2025. The month before their separation, there were arguments between the couple, one of which ended with the defendant striking his wife in the face with a cellphone.”

The firefighter was arrested by the Public Security Police (PSP) on August 26 after being filmed assaulting his wife in front of their young son. At the time, he was placed in preventive custody.

The assault, which occurred in front of the couple’s 9-year-old son, was captured by surveillance cameras in the victim’s home and widely shared on social media.

The footage shows the man approaching the house door and ringing the bell. This is followed by shouting and assaults. The child tried to protect his mother and pleaded with his father to stop.

As the man leaves, the boy asks his mother to get up while trying to help her. “I can’t,” she responds in tears.

In September, the firefighter’s defense filed a habeas corpus request with the Supreme Court, arguing that their client was “illegally imprisoned.”

Subsequently, the Supreme Court rejected the habeas corpus request for the Madeira firefighter, stating there was no basis for the application and imposing a judicial fee of 1,020 euros.
