José Luís Carneiro addressed journalists in Lagoa, in the Faro district, at the presentation of the municipal candidacy of the current mayor, Luís Encarnação, who is seeking re-election for a second consecutive term in this municipality of the Faro district.
“This is a victory of constitutional values over the arrogance with which the Government faced this challenge. The government was warned by the Socialist Party that the radical options it was adopting in immigration law, forming an alliance with Chega, would lead to poor outcomes,” reacted the PS leader.
The Socialist General Secretary considered that the legislation in question was crafted in a manner that trampled democratic values, particularly at the heart of democracy, within the Assembly of the Republic, without providing space for political dialogue or consultation with “mandatory entities, particularly the higher courts.”
José Luís Carneiro recalled that the Government defended the legislative solution approved, with the votes from PSD and Chega and with criticism from the parliamentary left, as “a humanist option,” but not only “was it not a humanist option, it grossly violated constitutional values and called into question the fundamental rights of the human person and families,” he maintained.
The Constitutional Court found that the legislative proposal in question “did not protect families, particularly women and children,” and the outcome is “quite embarrassing for the Government,” stated the PS leader.
“I hope the Prime Minister and the Minister of the Presidency will gain some democratic humility to end the haughtiness, arrogance, and to seek dialogue. I hope the Prime Minister has already issued instructions to correct the errors identified by the Constitutional Court,” said the Socialist leader.
According to José Luís Carneiro, family reunification is “a fundamental right for the protection of the human person and the family,” and the Government should listen more to the PS and the President of the Republic, Marcelo Rebelo de Sousa, who promptly vetoed the proposal after the Constitutional Court’s decision was known.
The PS leader highlighted his constant readiness for dialogue since becoming the party’s General Secretary, emphasizing that it was the Government that, “with its arrogance, wanted to walk and establish an agreement with Chega on these matters.”
“What the Government is doing is choosing a radical, far-right, inhumane path that calls fundamental rights into question,” the party leader further stated, assuring that the PS will remain “where it has always been, defending these values” and ready to “create the best solutions for the country’s interest.”

The Socialist leader stated today that the Government, the AD, and Chega were defeated with the Constitutional Court’s rejection of the foreigners’ law, arguing that the Prime Minister should “listen more” to the President of the Republic and the PS.

The Constitutional Court (TC) today announced the rejection of five provisions of the Parliament’s decree that approves the legal regime of entry, stay, exit, and removal of foreigners from the national territory.
The diploma, sent by the President of the Republic to the TC for constitutional review on July 24, will now be returned to Parliament so that the provisions that violate the fundamental law can be removed.
