
Employees who participate in a strike are exempt from attending work but do not receive the portion of their salary corresponding to the time they were absent.
“During a strike, employees are excused from attending work and following employer’s instructions, while most of their rights and obligations remain,” stated DECO PROTeste.
This means that “as long as the strike adheres to all necessary formalities, the absences must be considered justified.”
“Additionally, despite their absence, those days count towards seniority within the company. If the employee is receiving a Social Security benefit or due to a work accident or occupational illness, the payment continues,” further explained the consumer protection organization.
Is salary affected? Yes
However, DECO PROTeste explains that a striking worker “loses the right to remuneration, meaning they do not receive salary for the period they were absent.”
“This is, indeed, cited as the greatest disadvantage by those who strike,” it concludes.
