The Court of Appeals has acquitted Clóvis Abreu of the charge of aggravated homicide in the case concerning the death of former Public Security Police officer Fábio Guerra.
The court concluded that it was not proven that Clóvis Abreu kicked the victim’s head.
Clóvis Abreu, who was sentenced to 14 years in prison last November, had been convicted of aggravated homicide, attempted homicide, and causing bodily harm. His sentence has now been reduced to six years in prison.
Moreover, Abreu is ordered to pay 184,000 euros in compensation to the victim’s family.
Clóvis was the third defendant to be convicted for the death of Fábio Guerra after the Lisbon Court ruled that he acted in concert with former marines Cláudio Coimbra and Vadym Hrinko, who received sentences of 20 and 17 years, respectively.
The death of Fábio Guerra occurred in March 2022 following an assault outside the Mome nightclub in Lisbon. The 26-year-old passed away on March 21 at São José Hospital due to “severe brain injuries” sustained during the attack.
In September 2023, Clóvis Abreu surrendered to authorities over a year after the crime took place. His lawyer stated that during that year and a half, arguing he was “never on the run.” “He was never notified to appear,” the lawyer explained at the time.
