How many days? Are they paid? Is this how absences for those with endometriosis will be?

Friday saw the publication of a new law enhancing the rights of individuals with endometriosis or adenomyosis by improving their access to healthcare and introducing a system for justified absences from work and school, which amends the Labor Code.

The legislation states, “This law promotes the rights of individuals with endometriosis or adenomyosis by enhancing their access to healthcare and establishing a system for justified absences from work and school for up to three consecutive days per month, amending the Labor Code,” as articulated in the document.

Under the newly published law, it is stipulated that a “worker experiencing severe and incapacitating pain caused by endometriosis or adenomyosis during the menstrual period has the right to justified absence from work, without any loss of rights, including remuneration, for up to three consecutive days for each month of work,” the text explains.

To support this, “A medical prescription confirming endometriosis or adenomyosis with incapacitating pain is submitted to the employer and serves as justification for the leave, eliminating the need for monthly renewal,” the document continues.

Justified Absences from School

The law also provides that “an individual suffering from severe and incapacitating pain caused by endometriosis or adenomyosis during the menstrual period has the right to justified absences from classes, without any loss of rights, for up to three consecutive days per month.”

According to the law, “A medical prescription confirming endometriosis or adenomyosis with incapacitating pain is submitted to the educational institution and serves as justification for the absence, without the need for monthly renewal,” it states.
