IL available to negotiate a solution with the Government on the foreigner’s law

In a letter addressed to Carlos Abreu Amorim, Minister for Parliamentary Affairs, Mariana Leitão offers to engage in dialogue with the government to achieve an “urgent and rigorous solution” for the legislation that, due to its rejection by the Constitutional Court and veto by the President, cannot be enacted and must be reconsidered and voted on in parliament.

In the letter, Mariana Leitão expresses that to avoid a potential “undesirable impasse,” IL is willing to negotiate an urgent, rigorous solution with appropriate procedural safeguards.

She also expresses readiness to, as a result of a “negotiated solution,” participate in a potential two-thirds majority for approving the bill if the amended proposal continues to evoke politically motivated reservations from the Constitutional Court.

The legislation recently struck down by Constitutional Court judges was approved on July 16 in the Assembly of the Republic, with favorable votes from PSD, Chega, and CDS-PP, IL abstaining, and votes against from PS, Livre, PCP, BE, PAN, and JPP.

The Constitutional Court rejected five provisions of the parliamentary decree that establishes the legal framework for the entry, stay, exit, and removal of foreigners from the national territory.

The decree, sent by President Marcelo Rebelo de Sousa to the Constitutional Court for constitutional review on July 24, will now be returned to parliament for amendments to the provisions that violate the fundamental law.
