The lawyer representing a firefighter from Madeira, detained last week on charges of domestic violence, disclosed on Tuesday that two requests for the defendant’s release have been submitted.
“At this moment, I am seeking the immediate release of this defendant because I believe he is in an illegal detention situation. In response, I have filed an appeal with the Lisbon Court of Appeal and also submitted a habeas corpus petition to the Supreme Court of Justice,” stated Nanci Camacho in a statement to Antena 1.
The firefighter’s lawyer reiterated her belief that the defendant “is in an illegal detention,” explaining that the specified risks have not been verified.
“In this specific situation, I believe that the risks of flight, interference with the investigation, and disruption of public order and tranquility are not present. It is essential to consider that these risks are not only analyzed based on past actions, but also a judgment must be made on the defendant’s future behavior to determine if these risks exist,” she said.
The lawyer also deemed the pre-trial detention excessive, reiterating that the aforementioned risks were not verified. “Since those risks are not present, a more severe measure than an identity and residence term should not have been applied.”
It is noteworthy that the firefighter was detained by the Public Security Police (PSP) on Tuesday, August 26, after being filmed assaulting his wife in front of their minor child in Machico, Madeira, and was subjected to pre-trial detention.
