MP shelved the investigation opened without basis against Spinumviva.

The opening and subsequent closure of a criminal investigation by a Department of Criminal Investigation and Action (DIAP) was reported today and confirmed by the Attorney General’s Office (PGR). The situation arose from a repeated complaint sent via email by a citizen concerning Luís Montenegro and his family company, Spinumviva, to the PGR, the Central Department of Investigation and Prosecution (DCIAP), and various DIAPs.

The PGR explained that these identical complaints were forwarded to the DCIAP, where a preliminary investigation is ongoing to determine any potential criminal matters that might justify opening a formal inquiry.

Regarding these identical complaints, the PGR clarified that they did not include any factual accounts capable of constituting a crime, and therefore, there was no basis to open an inquiry, leading to their archival.

“However, in one DIAP, one of these identical complaints was registered as an inquiry, which was subsequently sent to the DCIAP. Since the inquiry did not contain any facts capable of constituting a crime, it was promptly archived,” stated the PGR.

The PGR did not specify when the criminal inquiry was opened and closed, what actions were conducted within its scope, or the consequences.

It was reiterated that the preventive investigation remains “ongoing,” with the Attorney General, Amadeu Guerra, expressing in an interview his hope to conclude it before the judicial holidays starting on July 15.

Previously, the significant volume of documentation related to this preventive investigation had been noted, for which the Judiciary Police was called in for analysis.
