
The decision to advance with two requests to the Constitutional Court was announced at a press conference by the PS’s parliamentary leader, Eurico Brilhante Dias, accompanied by deputies Pedro Delgado Alves and Isabel Moreira, citing legal security issues raised by the two decrees.
The decrees amending the Nationality Law were approved on October 28, with 157 votes in favor from PSD, Chega, IL, CDS-PP, and JPP, and 64 votes against from PS, Livre, PCP, BE, and PAN, and proceeded to the Palácio de Belém on Tuesday.
The Constitution stipulates that legislative initiatives regarding “the acquisition, loss, and reacquisition of Portuguese citizenship” must take the form of an organic law.
Being organic laws, within eight days from the date of receipt of the decrees, in addition to the President of the Republic, the prime minister and one-fifth of the deputies—46 out of 230—may request a preventive review of any of their provisions, according to the Constitution—a right now exercised by the PS.
