Parental leave can reach six months when shared between parents

The draft labor law reform indicates that “the initial parental leave may last up to 180 consecutive days.”

The current Labor Code grants mothers and fathers the right to parental leave of 120 or 150 consecutive days, which can be shared after birth and taken simultaneously by both parents.

With the proposed changes by the Government, the initial parental leave could extend to six months if, after the mandatory 120 days—”which can be shared between the parents”—they choose an additional 60 days, on a shared basis equally divided.

If not, the leave can be up to 150 days, with an optional additional period of 30 days on top of the 120 mandatory days.

The existing Labor Code already allows for the initial parental leave to last 180 days if parents decide on 150 consecutive days, “in the case of each parent taking, exclusively, a period of 30 consecutive days, or two periods of 15 consecutive days, after the mandatory leave period by the mother.”
