Rehabilitation technicians’ union takes legal action for “illegal working hours”.

A lawsuit has been filed with the Porto Administrative Court against the Ministry of Justice for “illegal working hours” and “excessive workload” that violate the right to rest.

In the lawsuit, the technicians’ union of the General Directorate of Rehabilitation and Penitentiary Services (DGRSP) calls on the Ministry of Justice (which includes the DGRSP) not to assign senior rehabilitation technicians, senior social rehabilitation technicians and professional rehabilitation technicians “illegal working hours, either through the excessive workload they contain, or through the violation of their right to rest between shifts, or through the lack of compensation for overtime worked”.

In the same complaint, the union also calls for the payment of a “just and adequate daily penalty”, should the violation of the law continue, to be condemned to the “patrimonial sphere” of the Director General of Rehabilitation and Penitentiary Services.

Last April, the Syndicat des techniciens de la Direction générale de la réinsertion et des services pénitentiaires (SinDGRSP) took legal action against the Ministry of Justice for the lack of promotions and competitions for career advancement over the past 15 years.

This action, also of an administrative nature, has also been brought before the Porto Administrative and Fiscal Court, concerning the situation of six technicians benefiting from career progression conditions and who are complaining about the Ministry’s actions.

These professionals are asking the Court to order the government to fix, for each of the years in which they should have been promoted, the number of vacant positions in their careers and to open the competitions that have been delayed.

The union, which has already called an overtime strike this year, has alerted the government to the unattractiveness of careers, delays in promotions and staff shortages.
