Ruling should allow the resolution of “immense cases” of patients without benefits

“There are numerous such cases we are aware of, but until now, the Tax Authority (AT) did not give any support to our petitions. Now, this ruling from the Supreme Administrative Court (STA) has given us significant strength,” explained the president of the LPCC to Lusa.

The issue stems from a ruling by the STA on March 2, which confirmed that a taxpayer, an oncology patient, could not lose the tax benefits to which she was entitled, after being awarded a 60% degree of permanent disability in 2015, even if later re-evaluation reduced that level of disability.

According to Vítor Veloso, this decision by the STA, after several appeals by the AT, supports the LPCC’s stance since 2019 that in such situations, patients “should not be penalized and must continue to enjoy the tax benefits they previously had.”

“It is a recurring situation where we had made numerous petitions and clarifications at the level of various governments, but we had not managed to reach a favorable outcome,” added the league’s president.

Vítor Veloso further mentioned that the LPCC will request a meeting with the Ministry of Finance to seek clarification on the matter, arguing that it only requires government guidance directed at the AT to resolve it.

“It only takes the Secretary of State to give directions in this regard with a circular letter for the situation to be resolved,” emphasized the league’s head, noting that this benefit “should be considered because it is correct and fair.”
