Supreme Court denies Ivo Rosa access to inquiries he was subjected to

A complaint is set to be filed with the Prosecutor General’s Office by the magistrate following recent developments.

Access was denied to three archived criminal inquiries in the Supreme Court, in which Ivo Rosa was investigated over recent years. This decision was made by the same deputy attorney general who previously closed the crime inquiry concerning allegations of corruption, embezzlement, and money laundering, stating the original complaint “lacked any credibility.”

The final order called for the destruction of the case files, which reportedly has not yet occurred.

Ivo Rosa, responsible for the indictment in the Marquês Operation in 2021, dismissed numerous charges against former Prime Minister José Sócrates.

The denial of access was formally explained by the argument that Ivo Rosa did not demonstrate a legitimate interest in these consultations in his requests, despite being the subject of the three Supreme Court archived criminal inquiries.

This month marks the second denial from the Supreme Court on requests submitted by Ivo Rosa to access the files, following an initial request on October 5, reacting to a CNN Portugal report that he was secretly investigated for three years starting in 2021 for alleged corruption.

Revelations included scrutiny of his bank accounts and phone records, along with the Public Prosecution’s access to his geolocation data.

The initial request was not reviewed “for seemingly bureaucratic reasons.”

The Supreme Court indicated that a separate request would be required for each archived criminal inquiry.

Furthermore, regarding a similar request at the same time, the Prosecutor General’s Office informed him that the application must be resubmitted in signed paper form.

To avoid further issues, the magistrate personally delivered three paper and signed consultation requests to the Supreme Court’s office in Lisbon on October 8.

Ivo Rosa also sought access from the Public Prosecution team at the Lisbon Court of Appeal, where he has served as an appellate judge since 2022 and was also previously investigated. Utilizing the same request wording to the Supreme Court, he received approval to access these files.

The investigative judge in the Marquês Operation faced five criminal investigations in the Court of Appeal, which he learned from this court recently, bringing the total number of inquiries targeting him to eight.
