Supreme Court forces CSM to review the score of seven judges who applied to the Court of Appeal

After the release of the lists from the curricular competition for access to the appeal courts, which aims to promote first-instance judges to appellate judges, several magistrates have sought to contest the process in the Supreme Court of Justice. This has prompted a “new assessment of the curricula of candidates who filed the actions,” according to the Superior Council of the Judiciary.

Information provided by CSM indicates that nine administrative actions were filed with the Supreme Court of Justice, with the intent of annulling the results of the latest competition held in June 2024, as well as the final scoring tables.

Currently, one of the nine actions is still awaiting a decision from the Supreme Court of Justice, while another led to the acquittal of the CSM.

In the remaining seven cases, the Supreme Court’s decision partially accepted the plaintiffs’ claims. While the annulment of the competition was not granted, “a revision of the scores assigned in one of the evaluation factors” was ordered, as explained by the council.

The score revision concerns the manner in which the competition jury interpreted the overall evaluation trajectory of the candidates, which is one of the assessment criteria.

The CSM is presently engaged in “preparatory work to reformulate the necessary assessment judgments,” with a decision to be made in a plenary session.
