The Supreme Court of Justice (STJ) has rejected the request for the release of the Madeira firefighter who assaulted his wife at the end of August. As a result, the man will remain in pre-trial detention.
The court’s decision stated that there was no reason for a habeas corpus application, also imposing a court fee of 1,020 euros.
The habeas corpus request was submitted by the defense lawyer, Nanci Camacho.
The lawyer had argued that her client was “in an illegal detention situation” and had therefore filed “an appeal with the Court of Appeal,” as well as “a habeas corpus request to the STJ.”

The firefighter, a native of Machico, Madeira, was arrested by the Public Security Police (PSP) on August 26, after being filmed assaulting his wife in front of their minor child, and was subjected to the preventive detention measure.

The images of the assaults, which occurred in the presence of the couple’s nine-year-old son, were captured by surveillance cameras at the victim’s home and widely shared on social media.
In the footage, the man is seen approaching the door of a house and ringing the doorbell, followed by screams and assaults. The child tried to protect his mother and pleaded with his father to stop.
When the man leaves the scene, the boy asks his mother to get up while he tries to help her. “I can’t,” replies the woman, in tears.

A firefighter from Machico, on the island of Madeira, was detained after a violent assault on his partner, in front of their nine-year-old son, was recorded. The coercive measures are expected to be announced today.
