Teachers challenge the unconstitutionality of the ban on re-enrolling in the CGA.

The Fenprof union has sought assistance from Amadeu Guerra to promote a declaration of unconstitutionality at the Constitutional Court (TC) regarding a law that aims to prevent the re-enrollment of workers, primarily teachers, in the Caixa Geral de Aposentações (CGA), according to the federation’s statement.

The TC has already ruled favorably in more than a dozen cases filed by teachers supported by Fenprof, but the educators are pushing for the standard to be declared unconstitutional, the statement adds.

“Over the past few years, dozens of teachers have seen their cases affected by conflicting interpretations and decisions across various instances regarding re-enrollment in the CGA. The situation created by the new law has worsened this scenario, violating fundamental principles such as the protection of trust and the legal and professional stability of workers,” argues Fenprof.

Therefore, the largest representative trade union for teachers in Portugal has submitted a request to the Attorney General, considering that it could “end the legal uncertainty affecting thousands of workers.”

The Caixa Geral de Aposentações (CGA) is responsible for managing the social security of public employees and equivalents. However, teachers who began their roles after 2006 were barred from registering in the CGA, a system more advantageous to workers compared to Social Security.

Recently, the Constitutional Court confirmed judicial decisions declaring unconstitutional the recent law that barred teachers from re-enrolling in the CGA, allowing their reintegration.
