Van caught on radar. Funeral home said dead young man was driving.

A manager from Funeralbi, a company based in Castelo Branco, filled out a form with details of 19-year-old Rodrigo Oliveira, whose funeral he had conducted days earlier, in response to a notification from the National Road Safety Authority (ANSR) to identify the driver of a vehicle violating traffic laws, according to the Public Prosecutor’s Office (MP).

On December 31, 2023, at 4:38 PM, a funeral van was caught on a radar on the National Road 119 in Santarém, an area with a speed limit of 50 kilometers per hour. The vehicle was traveling at 102 kilometers per hour, as per documents accessed by the news agency.

The indictment stated that the manager is “responsible for the collection, processing, and protection of personal data of the clients” of the accused Funeralbi.

The accused had documents of the young Rodrigo Oliveira in their possession because they handled his funeral on January 12, 2024.

The ANSR notification arrived on January 25, 12 days after the funeral, with the accused using the young man’s details as the vehicle driver.

Initially shocked, the parents were outraged upon learning of the situation, especially because they lost their son in a traffic accident, prompting them to take legal action, emphasized the family’s lawyer, Hélder Conceição.

The MP also requested that the state confiscate the benefit obtained by the accused from this act, which amounts to 300 euros, the value of the traffic fine for speeding.

According to the prosecution, the notification received by the family entailed a fine between 300 and 1,500 euros and a driving license suspension ranging from two to 24 months.

The crimes in question could cumulatively lead to a maximum penalty of seven years in prison. The MP’s indictment further anticipates that the case be reported to the Food and Economic Security Authority (ASAE) and the National Data Protection Commission (CNPD).
