“We do not agree with the TC, but we will comply and accept this decision”

The parliamentary leader of the CDS-PP responded on Friday to the Constitutional Court’s (TC) decision to reject the Foreigners Law. Paulo Núncio stated that the party “disagrees with some points raised by the TC,” but they will “comply and accept this decision.”

The centrist admitted that “the government and the majority supporting it will make the necessary adjustments,” but reiterated their commitment to “revising the foreigners law and strengthening immigration laws,” arguing that this is a national necessity.

“Our goal is to bring order to immigration,” added Núncio, who also took the opportunity to accuse the Socialist Party (PS) of being solely responsible for the “chaotic situation” in immigration.

The centrist parliamentary leader expressed confidence in a possible agreement in Parliament to approve new amendments but noted that, for now, the issues raised by the TC “need to be analyzed.”

“The Government will take the initiative to propose solutions that allow immigration to be ordered, while also addressing the constitutional issues,” concluded the centrist.

Constitutional Court Rejected the Foreigners Law

Paulo Núncio’s reaction comes shortly after the TC declared five provisions of the Foreigners Law unconstitutional, resulting in the document being returned to Parliament to remove these provisions that violate the fundamental law.

The President of the Republic submitted to the Constitutional Court the decree that changes the legal regime of entry, stay, exit, and removal of foreigners from the national territory on July 24. Marcelo Rebelo de Sousa had doubts about its constitutionality.

Following this TC decision, the President of the Republic also announced, in a note on the presidency’s website, that he vetoed the decree.

“Following today’s Constitutional Court ruling, which declared unconstitutional five provisions of the legislation submitted for preventive constitutional review, the President of the Republic will return the Assembly of the Republic without promulgation, under Article 279(1) of the Constitution, the decree that amends Law No. 23/2007, of July 4, which approves the legal regime of entry, stay, exit, and removal of foreigners from the national territory,” stated a note published on the Presidency’s website.

Marcelo vetoes Foreigners Law and returns decree to Parliament

Marcelo Rebelo de Sousa vetoed the Foreigners Law on Friday, thereby returning the decree to the Assembly of the Republic after the Constitutional Court (TC) declared five provisions unconstitutional.
